These describe two separate choices. SCOPE: a general power of attorney gives your agent broad authority over the financial and legal matters you grant, while a limited (or special) power of attorney is confined to specific acts — for example selling one vehicle or managing one account for a set period. EFFECT ON INCAPACITY: a durable power of attorney stays in effect even if you later become incapacitated (usually the whole point for estate planning), whereas a non-durable one ends the moment you lose capacity. TIMING: a power of attorney effective immediately works as soon as it is signed, while a springing power takes effect only when a future condition occurs, most commonly a physician certifying that you are incapacitated. This generator lets you set the type and toggle durable and springing independently, and rewrites the scope, durability and effectiveness clauses to match. Note that some states disfavor or add requirements to springing powers because incapacity can be hard to prove.

In every state the principal must sign the power of attorney, but the signing formalities vary widely. Many states require the document to be acknowledged before a notary public; many require one or two witnesses; and some require both a notary and two witnesses. A number of states also publish an official statutory power-of-attorney form that banks and other third parties expect to see, and an agent may have trouble using a POA that does not follow it. A witness usually must be a competent adult who is not the agent, the agent’s spouse, or the notary. Because of all this, a power of attorney that omits the required wording, witnesses or notarization may be invalid or simply refused. This generator ends the document with a signature line, witness lines and a notary acknowledgment block, but it cannot know your state’s exact requirements, so confirm them and have the document signed, witnessed and notarized as your jurisdiction requires before relying on it.

This tool builds a financial / general power of attorney covering money and property — banking, real estate, taxes, benefits, business and similar matters. It does not, and the generated document expressly states it does not, authorize anyone to make health-care or medical-treatment decisions for you. Those decisions are governed by a separate document, usually called a health-care (or medical) power of attorney, health-care proxy, or advance directive, which has its own statutory form, witnessing and notarization rules that differ by state and often must be drafted on an official form. If you also want someone to make medical decisions if you cannot, prepare that separate document — ideally with a lawyer — in addition to this one.
